Robertsbridge Rugby Football Club Rules

1) Name and Affiliations.

The name of the Club shall be “Robertsbridge Rugby Football Club or Robertsbridge RFC” (hereinafter referred to as “the Club”) and the primary object of the Club shall be the playing and promotion of the amateur sport of Rugby Football. In the pursuance of this objective, the Club will be represented by a playing kit of blue and black quartered shirts, black shorts and black socks.

The Club shall be members of the Rugby Football Union, Sussex Rugby Football Union and the Kent Rugby Football Union.

2) Management and Administration.

The management and administration of the affairs, engagements and concerns of the Club shall be entrusted to a General Management Committee (GMC). The GMC will act in the best interests of the club and its members in pursuance of the clubs objectives. (Composition of the GMC is dealt with at clause 3 Club Officers.)

The Committee will have due regard to the law on disability discrimination and child protection.

The GMC shall have the power to co-opt without reference

a) The GMC shall have the power to transfer the assets of the Club to a Limited Company to be incorporated for the purpose of transacting such part or parts of the Club’s business as the Committee may consider expedient. The GMC shall have the power to deal with the funds and property of the Club and to do all things that maybe necessary to carry on the Club including the election of members and their expulsion if their conduct be injurious to the character or interest of the Club, and for this latter object a majority to be binding must consist of two-thirds of the Committee.

b) The GMC shall have the power to delegate all or any of these duties to a sub-Committee or committees except the power of expelling a member.

c) The quorum of the GMC for all purposes shall be three Committee members.

d) The election of Team Captain or Captains shall be determined by the GMC having taken due account of the recommendations of the full members of the club.

e) The GMC is expressly restricted from making decisions without reference to the club at a properly called meeting on the following matters :

• Permanent changes of club venue (in case of emergency the GMC can decide on a new location for a limited period of time)
• A change of playing colours
• A change of the Club’s name
• Involvement in leagues.
• The winding up of the club

In the advent of a winding up the members may vote to wind up the Club if not less than three quarters of those present and voting support that proposal at a properly convened General Meeting. The Committee will then be responsible for the orderly winding up of the Club’s affairs. After settling all liabilities of the Club, the Committee shall dispose of the net assets remaining to one or more of the following:

• To another Club with similar sports purposes which is a registered charity and/or
• To another Club with similar sports purposes which is a registered Community Amateur Sports Club (CASC) and/or
• To the Club’s governing body for use by them for a related community sports.

3) Club Officers.

The GMC which shall comprise five elected officers, namely the Chairman, Hon Secretary, Hon Treasurer, Social Secretary and Resources Officer. Such officers will be appointed at the AGM and will be eligible for re-election. If such officers fail to fulfil their responsibilities they can be removed by a two thirds majority at a Special General Meeting.

The GMC will appoint a Child Welfare Officer without reference to the Club.

The GMC shall have the power to co-opt without reference

4) Meetings.

The Annual General Meeting (AGM) shall be held before 30th May each year to receive the report of the Committee and Statement of Accounts, to elect Officers for the ensuing year and to fix annual subscriptions for all classes of membership. All Officers of the Club shall be eligible for re-election.

The notices calling such meeting, stating the business to be considered thereat, shall be announced in the press, on club notice boards and on the club’s website, www.rrfc.org.uk at least 14 days prior to the fixed date for this meeting.

None of the rules shall be altered, added to or deleted and no new rules shall be made except with the sanction of two-thirds of the members present at and voting at a General Meeting.

Notice in writing of any proposed alteration or addition to these rules shall be sent to the Hon Secretary no later than 30th April preceding each and every AGM.

The Hon. Secretary shall upon written request from ten Members setting out their requirements call a Special General Meeting of the Members of the Club; such meeting shall be convened by notice in writing and circulated to each Member at least seven days before the date fixed for such meeting. The notice convening a Special General Meeting shall state the business to be transacted thereat

5) Membership.

Membership of the Club shall be open to anyone interested in Rugby, on application, regardless of sex, age, disability, ethnicity, nationality, sexual orientation, religion or other beliefs. However, limitation on membership according to available facilities is allowable on a non discriminatory basis. Every candidate for Membership of the Club must be proposed by either a Playing Member or Vice President and seconded by another member. The name of the proposed member shall then be placed before the General Committee for their approval. New members shall not be entitled to the privileges of the Club if:-

• Their subscriptions for the current year are not paid within one month of their being enrolled.

• An interval of at least two days shall not have elapsed between their nomination and their approval by the General Committee.

The club has the following different classes of membership and subscription which are based on a non discriminatory and fair basis. The club will keep subscriptions at levels that will not pose a significant obstacle to people participating. A candidate for membership of the Club shall (subject to the qualification, herein appearing) be eligible to be elected to one of the following classes of Membership:-

• Vice President (awarded at the sole discretion of the GMC)

• Playing Member

• Social Member

• Family Membership (only the Partner of a member shall be entitled to join the Club as a family member. This membership entitles the Member’s family to use the Club’s facilities.)

Playing members must notify any change of personal details to the Hon. Secretary promptly

The General Committee may refuse membership, or remove it, only for good cause such as conduct or character likely to bring the club or sport of Rugby into disrepute. Appeal against any refusal or removal may be made to the members.

Resignations from membership shall be sent in writing to the Hon. Secretary of the Club and any Member not having sent in his resignation prior to the date of the Annual General Meeting shall be considered a Member for the ensuing year and liable for his subscription accordingly.

6) Subscriptions.

The subscription year shall be from 1st June in one year to 31st May the following year. All annual subscriptions shall be due and payable to the Hon. Treasurer, on or before the first day of October each year. Subscriptions for the following year will be approved by the club at the AGM following a recommendation from the Treasurer.

Such subscriptions will be paid if possible by standing order with the first payment in June or by lump sum payment. Any other form of payment has to be agreed with the Treasurer.

Any playing Member who has not paid his annual subscription by 1st October shall not participate in any further games, practice or training organised by or for the Club until he has paid his subscription to the Hon. Treasurer.

Any Member who has not paid his annual subscription by 1st January, or any new Member who has not paid his subscription within one calendar month of his being accepted as a Member of the Club, shall at the discretion of the Committee cease to be a Member of the Club.

Playing Members of the Club who go away to University or College or who join the Merchant Navy or Armed Forces and who will not be eligible for selection for more than one-third of the matches in the season may pay a reduced membership subscription

7) Finance and Accounts.

All accounts will be maintained in the name of Robertsbridge RFC with Lloyds TSB plc.
The operation of the Club’s bank accounts shall be the responsibility of the Honorary Treasurer who will report regularly to the GMC. Annual Accounts will be provided to all members of the club at least 7 days before the AGM, at which time they will be formally presented for approval.

Any club expenditure has to be approved by the GMC and expense cannot be reimbursed without full supporting documentation.

Any cheques drawn on the accounts must be signed by the Hon Treasurer and countersigned by one of the following cheque signatories:-

• Chairman or
• Hon Secretary.

The property and funds of the club cannot be used for the direct or indirect private benefit of members other than as reasonably allowed by the Rules and all surplus income or profits are to remain invested in the club.

The Club may provide sporting and related social facilities, sporting equipment, coaching, courses, insurance cover, medical treatment, away match expenses, post match refreshments and other ordinary benefits of Community Sports Clubs as provided in the Finance Act 2002.

The Club may also in connection with the sports purposes of the Club

(a) Sell and supply food, drink and related sports clothing and equipment.
(b) Employ members (though NOT for playing) and remunerate them for providing goods and services, on fair terms set by the Committee without the person concerned being present.
(c) Pay for reasonable hospitality for visiting teams and guests.
(d) Indemnify the Committee and members acting properly in the course of running the club against any liability incurred in the proper running of the Club (but only to the extent of its’ assets).

8) Conduct and Discipline.

All members of the club are expected to behave in a manner that does nothing to impact on the reputation and name of the club. Any such behaviour will result in the matter being referred to the Club disciplinary committee. This committee will comprise the Chairman, the Hon Secretary and one other member of the club.

If a matter is referred to the Disciplinary Committee the subject of the complaint will be invited to a disciplinary meeting within 7 days of the date of the incident. The subject will be entitled to have one member of the club of his choice in attendance. The meeting will discuss the complaint and a decision given either at the meeting or within three days. The decision of the committee is final.

The committee has power to fine, suspend or expel a member for conduct that results in a disciplinary action.

Whilst the committee will decide on the merits of each case and thus an action to be taken, fixed penalties will apply as follows:
• For verbal abuse of match officials a minimum of a three match ban.
• For physical abuse of match officials, expulsion as a member and a lifetime ban.

9) Dress.

Playing members for matches will only wear approved club kit comprising team shirt and Club regulation shorts and stockings.

Pre and post match dress for all league matches will comprise white shirt, club tie and dark trousers. Failure to do so will result in a fine imposed by the current Captain. Continued failure to do so could result in disciplinary action being taken.

10) Miscellaneous.

• All members o the club are expected to have fun
• All members of the club are expected to support as many club functions as possible both in preparation for, attendance at and clearing after.
• All members at matches are expected to provide all playing equipment except for the regulation club playing shirt.
• Any playing member scoring three or more tries will be expected to purchase a jug for his team mates after the match. Failure to do so will increase the purchase to two jugs at the next opportunity.
• Any member exhibiting undue flashness either on or off the pitch will incur a penalty.
